The word "rape" really gets thrown around way too easily these days (And don't worry, I completely understand and appreciate the intention of your post). Rape is when a person is forced to engage in sex against their will, or without consent (such as if someone was unconcious,etc).
"Rape" should NOT be used to describe many of the acts that it currently does.
A 16/17 year old male and 15 year old female become bf and gf, and have sex frequently throughout their relationship. They date until the bf is over 18 and his gf is now 16. The gf's parents get upset with the bf for some reason and file a police report against him for having sex with their daughter. He is charged with statutory rape and is now a registered sex offender. His life is ruined because he is convicted of "rape", when in reality, it was nothing of the sort.
Then there's the possible B.S. Rape situation that can happen if you hook up with a chick who is somewhat drunk, even while you are also drunk. I'm talking about when she is still functional and not significantly more plastered than you. Women can claim that because they were drinking and intoxicated, that they couldn't actually give consent for sex, so it was rape. Even if you were more intoxicated than them, a guy could never get away with a claim like that. It's really just them doing something they regret due to bad judgment, not an inability to consent to something. If a poor sexual choice is excusable, and blamable, due to alcohol, then why doesn't the same logic apply to the myriad of other poor decisions people make while under the influence? "Oh, sorry for driving officer, but I am completely WASTED, so this isn't really my fault. I didn't really know what I was doing."
Ha, good luck with that one. You're better off making a run for it to some off-road area, ditching the car (and maybe torching it), and booking it on foot to safety.
