Future of NDAs
What will be the future of NDAs now? ...or business as usual?
shareWhat has happened recently that would change anything about NDA's?
shareSomeone became a felon as a result of an NDA
shareYou’ve been fed misinformation again
shareyeah I'm still not clear how.
Is there a law saying porn star affairs must be public knowledge before standing in an election?
Not that I'm aware of. But there is a law that says you cannot claim hush money payoffs as legal expenses. These details have been repeatedly posted on this forum.
shareIf the state was reimbursing him for legal expenses then I can see how that might be an issue .
But its his own money - he's not claiming it off anyone
Why do you think Trump claimed the hush money payments were actually legal expenses? It is because legal expenses are tax deductible. If Trump claimed a deduction and it was not a legal expense, then it is fraud.
Here were the instructions that the jury received. https://www.nycourts.gov/LegacyPDFS/press/PDFs/People%20v.%20DJT%20Jury%20Instructions%20and%20Charges%20FINAL%205-23-24.pdf
"If Trump claimed a deduction "
And did he do that ?
is that the issue?
The law does not say, "it's not fraud if you don't claim a deduction". Remember the "where is the victim" stuff you were talking about in another thread? Same thing. Take a look at the law and figure out what is going on instead of just making statements.
What part of the jury instructions did you not understand?
Thats like a 10,000 word document I'm not reading that .
If there is nobody here can say what the crime is in a simple laymans terms sentence then its obviously just a witch hunt on a accountancy technicality
I did find this bit
Under New York law, a person is guilty of Falsifying
Business Records in the Second Degree when with intent to
defraud, he or she makes or causes a false entry in the business
records of an enterprise.
but again for while I accept that a "victimless crime" is a thing , for fraud to occur someone needs to have been defrauded ,
So how would you describe this crime in simple english , withiut just saiyng "its fraud"
What fraud?
what happended ?
let me try.
"Trump gave stormy $130k and wrote it down as lawyer fees"
That is what I believe is the top and bottom of the case.
My question is ? whats wrong with that?
If he bought a chevy and wrote down "bought a Ford" would that be the same felony issue?
WTF, I've already posted it for you in another thread, or two. Why do you continue to claim ignorance?
Why do you claim that for fraud to occur that someone has to be defrauded? Are you aware of some special definition of the word fraud that no one else is aware of? Why don't you look up what fraud is in the NY statues? That is something else I already posted here on this forum in a thread you were whining in.
I already explained to you that legal expenses are deductible, so to call hush money a legal expense is fraud.
No, it was not as simple as Ford and Chevy. If Trump bought a car and wrote it down as a business expense when it was actually a personal vehicle for his own use outside of business, that would be fraud. Understand now?
So, how much money was the government cheated on, since you know, that is what this is about.
ok were getting somewhere
So what that boils down to is that you are saying that the entire reason for Donalds trial is that he did not pay tax on his pornstar payoff?
If he had not "Claimed the payment as a business expense" there would have been no problem?
Something like that. Did you read the links to the statutes I provided? You don't have to trust me or believe a word I say. Just read the statutes.
Trump's defense attorney's never disputed the validity of the statutes while in court. Why should they be disputed here on this forum?
What NDA? Who is making that claim? The prosecution? Trump? As far as I can tell, you're the only one making that claim.
I don't think a single prosecutor cared that a hush money payment was made. They cared about the fraud that was involved in hiding it. Here is where you can find over 480 links to educate yourself about Trump's stupidity that lead to his conviction. https://en.wikipedia.org/wiki/Prosecution_of_Donald_Trump_in_New_York
Why do you think no one ever got in trouble over an NDA before? Even the GOP favors limits on NDA's. https://www.congress.gov/bill/117th-congress/senate-bill/4524/text
NDS's will only apply to dems going forward.
shareWhere is its problem? https://fridaynight-funkin.io
shareI don't think the real message is limited to NDAs. The message is that if you are a problem for the Left, they will destroy you, by hook or by crook.
NDA was just the club that was most handy this time. Next time, it could be... perjury again, and by perjury, I mean misremembering a date and the judge pretending it was a lie.
Everything will remain the same. This sham trial, ruling will be tossed once it’s in front of a legitimate court.
