And worse, the 4 judges used the state’s dusty election code as the tool for finding guilt of “insurrection,” an allegation for which Trump has never been criminally charged. It seems a manifest violation of Trump’s due process rights by punishing him for a crime the government is incapable of obtaining a conviction. The public and the world will naturally presume that Democrats would never have bothered with this had Trump not presented a genuine likelihood of beating Joe Biden in the election. This is a major escalation of the Democratic party’s “lawfare” strategy against Trump which is only destroying faith in bedrock institutions and creating burning hot conditions for more violence.

shareEveryone focuses on Section 3 of that amendment, but Section 5 clearly says that only the US Congress can pass legislation to enforce the provisions of the amendment. Meaning none of the states can use it as a basis to prevent a candidate from appearing on the ballot. Only the US Congress can do that, and they haven't.
Considering that the judges didn’t bother reading the entire statement, SCOTUS will overturn this.
