Is it true squatters can't be removed from our home?
Eventhough they break-in, damaged our doors and painted our house walls to whatever they like and sleep at your beds?

shareI don't know the law in France, but it's probably true. It's even incredibly difficult to get squatters out in America. People have gone through some truly horrible things.

Especially if they are in a house which isn't occupied all the time, e.g. holiday homes.
In that case, police (and the judicial system) usually denies to help you because you still have another home where you can live.

Wrong. Lots of veterans have returned to homes filled with squatters. Depending on the city laws, the police hands are sometimes tied. A simple Google search will educate you.

Incredible that there are laws to protect the criminals (squatters) but not the homeowners.
A family moved to Fla from here in NY while they battled the insurance Co. and State relief red tape from Superstorm Sandy. Four squatters moved in and the police said they had to go through the 6-8 month eviction process. During that time the squatters burned the house down and one of them died from smoke.
Not only did the ins. co say they weren't coverd..have a nice day. A relative of the dead squatter filed a law suit againt the family because the smoke detectors weren't working.

In U.S.A, everyone is entitled to their own gun, and they can shoot anyone TRESPASSING their property right ?
shareWe have guns but can't just shoot anybody we want. To use deadly force, in most states a reasonable person would have to fear for his safety to use deadly force. Some states have a "castle doctrine" where there may be more latitude. But you can't just shoot someone to protect property.

Am not from London, but have been told by others from there, that England's squatter "rules" are similar.
shareYou are not allowed to kick someone out from the months of October to March. It's French law. Because it's winter. This doesn't apply to just squatters but anyone who doesn't pay their rent (maybe you lose your job? But French unemployment allows you to be paid 80% of your salary for 3 years). Don't get it twisted though, this also makes it difficult to rent. There's a lot of paperwork. Renting in Paris is a nightmare.

What if someday, in one winter, you went back from a trip your mother's house, and found several squatters all over your apartment enjoying your couch, tv, and bed ? French law DOES NOT ALLOW YOU TO EXPEL THOSE MENS ?
What if you are a woman living alone in your apartment ?

I don't know the specifics of the law. But I'm sure it's like most places where the person has to occupy the home for some amount of time before being allowed to have the law apply to them. And I'm sure they had to be a tenant. You have to show the authorities a lease.
This doesn't just apply to France, even though France has this protection law, there was a story recently about a lady in Palm Springs being unable to evict someone she was hosting from Airbnb because he stayed for over 30 days and he now fell under tenant protection. Did anyone see The Heights with Michael Keaton? Really creepy (American) movie.
And there's a difference between "tenants" and "squatters". Different laws apply. To even rent a flat in Paris landlords ask for a lot of paperwork. I'm sure this law has something to do with that.

I am okay with protection law that protects tenants or overdue tenants.
It is perfectly understandable.
But what about squatters? A.K.A trespassers?
Are there not even one person on this board that knows?
I'm fine with society having a system so homeless people don't die in the cold but this is just ridiculous.
Maybe build couple of shelters so you don't have to completely strip away peoples ownership and home privacy rights.
And people who rent a place and miss out on couple of payments should obviously be treated differently than people who are trespassing.

If I was away from my place for a while and returned to find a family living in it I would probably assume that I was well within my rights to kick them out!!
This situation works well in this fictional movie, as there is a very touching scene when the baby is born. But in real life, that law is a bunch of BS
Check out squatters rights in Florida. I saw an article on it a few years ago and it is shocking. It is really hard to remove a squatter from your home there legally. Even the neighbors are nice enough to run an extension cord to your house to give you some electricity. As unlikely as it is to happen, if you live in the home long enough and pay utilities with no contest from the homeowner then you become the legal owner of the home. I think it is somewhere around 10 years though.
