I would go with David Boreanez (spelling?), he played Angel the way Max was portrayed in the first game, I think he also has the acting chops to pull it off.
I'd imagine the perfect actor would be a non-action star who can act very vulnerable to pain (because Max lives up to his last name, a lot). And someone who acts brooding but not grizzled.
So who would be your top picks for Max if they did a reboot?
im probably alone in this one but im big mark fan and think he was a good Max payne all it needed was maybe a new director and script changes. but to each his own

I would have picked David Hayter since he nearly looked like Sam Jarvi back in 2001. Considering Hayter's busy screenwriting, it ain't gonna happen. My next pick would be Dean Winters (Charlie the paramedic from Terminator: The Sarah Connor Chronicles)

you're all horribly wrong, the one actor which stands head and shoulders above the rest for the role of Max Payne is Dean Winters. Rockstar (the company that actually created Max Payne) modeled the character on him.
If they did it again, maybe call it Max Payne: a new york minute or something
Remedy Entertainment made the game. Rockstar handled the ports to consoles.
I don't know about a reboot. I say let it sit for a while and then start it over with a better script.
Other than that, Dean Winters is an excellent actor and needs more work.

He was known for making those grimacing faces that really helped sell the "pain" effect. They simply changed his hair to a darker brown for the game, though.

i always thought timothy olyphant would make a good max payne. although he doesnt really have the voice for it, i think it could work.
shareNah, he has the potential looks but as you mentioend his voice doesn't match. And half the intrigue and desperation from Max was in his narrative.
Timothy's voice also failed him for Hitman. It was just too light for such a dark character, you know what I mean? I was waiting for him to say "Reaper...Tobias, Reaper" in that husky, nonchalant tone, but Tim just didn't have the gusto.
But for Max, the voice is everything and that was another thing Marky Mark was lacking in his portrayal of the Foreboding One.
Yes Michael madsen, always thought of him as a good MP. McCaffrey would be my first choice though
