And did that gun have a "safety" on it? The safety should have been on, his finger should have been off the trigger, and as George Clooney pointed out, he shouldn't have checked the gun to see if it was loaded and with what.

Dershowitz is of the opinion that if an actor is handed a gun and is told is is not loaded, then they are not responsible.

I say that everyone has a responsibility to treat all guns as if they are loaded, not to touch the trigger until they are ready to shoot and destroy anything they point at.

Correct! Killing someone accidentally is illegal, and can be prosecuted as manslaughter.

Not all people who cause accidental deaths are prosecuted, but as there have been allegations of negligence in this case, I'd say a trial is fair.

Would Dershowitz still absolve Alec of accountability if he had pointed a gun at his wife, husband, child, brother, sister…, at point blank range, pulled the trigger and shot them dead, the answer is an emphatic NO!

You assume too much, I watched the clip, and to say that Alec isn’t legally culpable, is to absolve him.
In regards to his point of view relating to my statement about his perception being different if a loved one of his had been on the receiving end of Alec’s negligent discharge, it is absolutely relevant, legal matters are swayed by subjective as well as objective reasoning.
For example, the organization MADD, have not only swayed public opinion on what the penalties should be concerning individuals who choose to drink and drive, they’ve had a direct influence on the very laws which hold those individuals accountable, and all of this being primarily accomplished through subjective and emotional reasoning.

It was an accident, but it happened because of negligence and stupidity. So there's still responsibility.

Yes, I agree 100%. A true accident, for example, would be if he was walking, holding the gun and he tripped and it went off because he tripped. THAT is a true accident. That is far from what happened. He was waving the gun around, acting stupid, and killed someone. It wasn't done on purpose, it wasn't his intention, but it was definitely, positively, negligent homicide due to his stupidity and extreme carelessness and he should be held responsible, along with the armorer.
