Ohio Forces Pregnancy on 10-Year-Old Rape Victim


Fortunately, a new Underground Railroad has been created to help women and girls get access to medical care in democratic states and foreign countries like Mexico and Canada.

"On Monday three days after the Supreme Court issued its groundbreaking decision to overturn Roe v. Wade, Dr. Caitlin Bernard, an Indianapolis obstetrician-gynecologist, took a call from a colleague, a child abuse doctor in Ohio.

Hours after the Supreme Court action, Ohio outlawed any abortion after six weeks, a child abuse doctor had a 10-year-old patient in the office who was six weeks and three days pregnant.

She would have to travel to Indiana where it's still legal. For now.

While Indiana law did not change last week when the Supreme Court issued its groundbreaking Dobbs decision, abortion providers here have felt an effect, experiencing a dramatic increase in the number of patients coming to their clinics from neighboring states with more restrictive policies.

Since Friday, the abortion clinics where Dr. Katie McHugh, an independent obstetrician-gynecologists works have seen “an insane amount of requests” from pregnant people in Kentucky and Ohio, where it is far more difficult to get an abortion.

A ban on abortions after six weeks took effect on last week in Ohio. Last Friday the two abortion providers in Kentucky shut their doors after that state’s trigger law banning abortions went into effect.

Indiana soon could have similar restrictions.

That pains doctors like Bernard.

“It’s hard to imagine that in just a few short weeks we will have no ability to provide that care,” Bernard said.

For now, Indiana abortion providers have been fielding more calls from neighboring states. Typically about five to eight patients a day might hail from out of state, said McHugh, who works at multiple clinics in central and southern Indiana. Now, the clinics are seeing about 20 such patients a day.

Kentucky patients have been coming to Indiana in higher numbers since earlier this spring when more restrictive laws took effect there, McHugh said.

A similar dynamic is at play at Women’s Med, a medical center that performs abortions in Indianapolis that has a sister center in Dayton, Ohio. In the past week, they have doubled the number of patients they treat for a complete procedure, accepting many referrals from their Ohio counterpart.

More than 100 patients in Dayton had to be scheduled at the Indianapolis facility, a representative for Women’s Med, wrote in an email to IndyStar.

Women and pregnant people are “crying, distraught, desperate, thankful and appreciative,” the representative wrote.

The two centers are working together to route patients to Indianapolis for a termination after a pre-op appointment in Dayton. In recent months, they have also had people from southern states, like Texas, come north for a procedure.

Many patients, particularly from Ohio and Kentucky, are seeking care through Women’s Med while also making multiple appointments in other states so if one state closes down, they will still have some options, the representative wrote.

The center is advising pregnant people with a positive pregnancy test to book an appointment even though prior to the Supreme Court ruling they asked people to wait until their six-week mark to do so.

For years people have traversed state lines for abortions, particularly if a clinic across the border is closer to their home than the nearest in-state facility.

In 2021, 465, or about 5.5% of the more than 8,400 abortions performed, were done on out-of-state residents, according to the Indiana Department of Health's most recent terminated pregnancy report. More than half, 264, lived in Kentucky and 40 in Ohio.

Midwestern residents can also travel to Illinois, where abortion is likely to remain legal even in the wake of the recent Supreme Court ruling but for many Indiana is closer and until the lawmakers pass any measure to the contrary, abortion will be legal here.

Still, it remains murky what the future holds.

Thursday a lower court ruled that abortions could resume, at least for now, in Kentucky. On Wednesday abortion clinics in Ohio filed suit, saying that state’s new ban was unconstitutional.

In Indiana lawmakers have declined to provide specifics of what measures any abortion legislation considered here might contain.

For now, then, abortion providers are doing their best to accommodate all Hoosier patients as well those from neighboring states.

“We are doing the best we can to increase availability and access as long as we can, knowing that this will be a temporary time frame that we can offer that assistance,” McHugh said."

Ohio AG claims ‘not a whisper’ about reported 10-year-old rape victim who got abortion:

Under Ohio law, physicians are required to report any case of known or suspected child abuse or neglect, including “suffering any physical or mental wound [or] injury.”

If, as Yost claims, law enforcement has no knowledge of a rape case involving a 10-year-old girl, that suggests that either the Ohio doctor violated state law by not reporting the crime or Bernard fabricated the incident to a credulous reporter.

“We don’t know who the originating doctor in Ohio was, if they even exist,” Yost told Watters on Monday night. “But the bottom line is, it is a crime — if you’re a mandated reporter — to fail to report.”

Some details of the story are starting to fall apart, but there may very well also be some core basis here.

Ohio law actually does not prohibit a 10-year-old girl from an abortion because it would clearly fall under the health exemption. Plus, no rape was reported, nor is there any investigation (yet), although I suspect the media coverage this is getting will prompt swift action. Who the hell wouldn't report the rape of a 10-year-old? It's possible an investigation is underway and just isn't known yet.

However, the possibility of this scenario cannot be fully dismissed, and it does call attention to the possible problematic nature of the various so-called "trigger laws" that need to be heavily scrutinized in some Red states, e.g. in my view the "heartbeat" criteria, which occurs at about 6 weeks, is too early (some women don't know they're pregnant by 6 weeks). Maybe a cognition responsiveness test should be devised instead, which puts it about 25 weeks, or at the very least double it to 12 weeks, or to maybe 20.

But the claim of the girl being turned away is on shaky ground, especially since there's no evidence of any abortion being refused to a 10-year-old girl, and the laws as they stand would have allowed it. Unfortunately, unsubstantiated claims seem to rule nowadays.

Of course, ideologues on one side are going to all jump on the bandwagon if it fits within their preferred narrative, while ideologues on the other side are going outright dismiss any aspect of the story and dub it "fake news" if some component doesn't fit their preconceived narrative. But we should all stop believing and instead start thinking critically. Until substantiated evidence of anything comes to light and is fully vetted, everything is merely a possible truth that exists in a superposition like a particle in a quantum state.

I wouldn't agree that the "abortion turn-away" portion can be dismissed. However, it is very questionable. I suspect there is a real child who was raped, but that the storyline of her being turned away in Ohio was a misunderstanding, if not outright fabrication.

Heard a VERY BRIEF update last night. They said "a child" has been identified, and there is a search for the rapist. That's all.

Still, where are the police reports? Where is the medical evidence (rape kit)?

I just saw an article saying they have a suspect in custody. The rape happened sometime in May. The article is very biased trying to throw it in people's faces for questioning the story when all people were doing were asking for the facts and details. I think it was atrocious that more people seemed to be concerned about the 10 year old going to another state for an abortion over finding out who the hell did this, why, when and where. Anyway, I don't know if I trust the new story because i think it's stupid convenient that it came out right when people started calling the story BS. But who knows. If it is real and the account really is this kid; I am sorry for the little girl and hope she can find peace and stability in the future. And shame on people using her as a political score point.

On which part? The bit where she was allegedly turned away for an abortion in Ohio? If so, that hasn't yet been substantiated, and as I stated above the laws on the books in Ohio actually allow for an abortion in this scenario, i.e. there's a health exemption (which is why I question it). Doesn't mean it didn't happen, however, because it's very possible that despite the legality of it some specific zealous doctor still turned her away. If it did in fact happen it's abhorrent and they should be ashamed.

Anyone not recognizing the extreme health risks to a 10-year-old girl giving birth is delusional.

Regardless, the current Ohio law is still far too restrictive (20 to 25 weeks is much more reasonable, and incest and rape exceptions are a must), and some Republicans in Ohio are introducing even more restrictive bills as we sit here comfortably in our chairs typing out these discussions. Congress REALLY needs to establish reasonable federal laws on the matter.

FACTS:
Ohio's abortion laws have a medical emergency exception, so there would have been no reason for the child to leave the state.
Dr. Caitlin Bernard's employer, Indiana University Health, has filed a HIPPA violation against her for sharing details about the young patient.
There is no evidence the young girl was forced to go to Indiana because she was denied an abortion in Ohio; she was likely just referred to a specialist in a different state.

The fact that the rapist has been arrested is irrelevant. It does not change the fact that the girl would not need to leave Ohio because Ohio's abortion law has a medical exception provision. There is also no evidence that the girl traveled to Indiana because she was denied care in Ohio; she may have just been recommended to a practitioner in another state, as this is very common.
The real shocker is that when the Democrats heard about a 10 year old girl being raped their first response was to worry about whether she would be able to get an abortion, not about the apprehension of the rapist.
