I think that whether is was rape or not is not quite clear, as it is not always a black and white situation. Certainly if the director wanted it to be flat out 'rape' he would have filmed it differently. I think the point is that she made a mistake bu getting into that situation with the guy..he was a bad person, but she was at fault too. It came across more like 'Oh my God, I can't believe I did that!', rather than 'Oh my God, I was raped!!!'

It *IS* a black and white rape situation, this isn't a "he said/she said." She was too intoxicated to give consent, she doesn't remember most of the night (and was very clearly drunk and drugged), the man (who appeared sober, just fyi) deliberately and systematically drugged her and led her to his car, etc. She never denied being raped - she just didn't remember everything that happened right away (they show her memories returning as "flashbacks" - the audience knows more than the character). After that, she says she doesn't want her b*tchy ex-gf to find out, which is why she doesn't go to the police (she is also afraid of what is happening to her AND the virus is starting to take her over and compel her to spread it). The shame and confusion she shows is VERY COMMON with rape victims. Most rapes are NOT reported. That has nothing to do with whether or not it happened.
How could she POSSIBLY be at fault? She very clearly said "no" while too intoxicated to really fight him off, then she blacked out. Getting into WHAT situation?

It is also not okay to foist a drugged drink on someone already intoxicated. She could have been too drunk/sedated from the drugs to get up and exit the car, or even push him off her. She didn't remember much the next day. The "rape" part of this movie is not meant to be debated, it is a concrete, black and white example of sexual battery.

I was pretty confused throughout most of this movie to notice very well. I don't remember her being raped exactly. I just remember her at the beginning getting drunk and then screwin some dude in her car. If she was drugged then I either missed it or they certainly didn't show it or elaborate on it clearly enough. But then again most of the crap in this movie had that problem. I'm not saying she wasn't raped I just wasn't sure at the time.

By contemporary standards, she was clearly sexually assaulted although I think there is some ambiguity about how, why and what state of mind she was in that led her to go to a car with a man unknown to her and start having sex with him.
I think this ambiguity kind of encapsulates what a lot of people start yelling about when the topic of sexual assault/date rape comes up.
Because it's a film and not security footage or a documentary, we don't know if he dragged her out to the car against her will or whether in her reduced state of self control and unhappiness with her girlfriend if she decided on some kind of revenge sex.

If that was video evidence, the prosecutors would not take it to trial.
She never says no, or stop.
She says "we should stop" "please" while she's in the middle of an orgasm.
This can be attributed to her guilt for cheating on her girlfriend, while having an orgasm.
