Abby offers him the job of Public Defender. Does a Judge have hiring authority for an Attorney who would appear in their court?

...You know this is a sitcom right?? They're allowed to take some liberties with reality...

Honestly, I feel like viewers today are so used to "reality tv" that they don't even know what a sitcom IS... Very sad...

It's not just a sitcom. It's Night Court. I wouldn't take it too seriously with the logic. This is a show that once had Wile E. Coyote make a cameo.

I think enough years have gone by where Dan should be the judge. That would be hilarious.

That would have made more sense and he could have been like a mentor to Judge Harry's daughter who is now an attorney. But of course that would mean having a white male playing the most authoritative character on the show so a big no no.
