just in the paper today a fireman came home and caught a burglar, use to this was not a crime where you could kill the perp, he had to be
1. in yer house
2. have a lethal weapon
3. threatening yer life
4 only after first retreating, then you could fire on him to act in self defense
now with the new castle Doctrine not the case! im really wishy washy about this too, in some cases it is good other cases, a teenager could be acting up doing something he would regret if he lived and now the homeowner can take him out w/o recourse, i dunno if i totally agree with the law.
Look up a Houston case, the old man calls 911 and says a neighbor is getting ripp off and he was gonna shoot him, 911 say DONT stay in yer house !" he says NO and so he goes outside and shoots the guys and kills them in his neighbor's yard, turns out they were illegal aliens with records for theft and the homeowner was not charged based on the castle doctrine.
we need such a law here in england. the law needs to protect us, not the intruders. so in the us, different states have different rules regarding burglars. what about shop/stores robberies, where the robber comes with a gun. are you allowed to blow him away? surely a guy robbing u at gunpoint, if that aint life-threatening, then i dont know what is
shareoh yeah that was legal years ago, in fact I worked for a lawyer years ago and next door was a small food store, they got broken into so many times, finally one day the roober came with a gun and as he was fleeing with the cash the owner/clerk shot him and killed him. I asked if he was in trouble and all the lawyers said NO WAY he has a right to protect his store. I didnt know but that was legal way before the castle doctrine was.

shareim not sure I know generally speaking the coasts are very liberal and the center and south US are more conserative so the criminal laws reflect that. A strange example is California has a death penalty but they havent put anyone to death since the 70's or 80's and chances are the condemned will live out their lives on death row wherease Texas will string um up in as little as 7 years.
My guess would be not many other states have this liberal of gun laws.

OL yer in the right state ! LOL I would think if I were a victim of a crime I would feel the same way. I surely would feel threatened if I caught someone in my house. Would I kill them? Well since I dont really own a gun I guess I could knock them in the head with my iron skillet but if someone else felt the need to blow them away, the law now allows this. I just hope I never have to face being a victim and I do feel for anyone who has had this experience. maybe if this law was in place up in Connecuit or wherever those 2 guys killed that doctors family, maybe they would have chose not to break into the house unless it was empty. For the life of me I cannot understand what drives sicko's like that and they both got the death penalty I think, at least one did for sure the other one with the foregin name is on trial now, hope he gets the same. He got out of jail because the system was so corrupt. That burglar was knowingly risking his life when he broke into another man's home. Period.

How often do the police kill an un-armed person who is trying to flee? I have seen it happen on the news. I sure as hell have more justification than they do on public property when a person is in the process of violating my home and still on my property.

I live in Florida and, like Texas, we have every right to kill an intruder. In fact, we have every right to kill anyone threatening our lives. It's called "Stand Your Ground."
I'm a proud liberal on most things, but when it comes to firearms and home protection, I get red fast. I've been a victim of home invasion. 5 gangsters rushed me in my apartment and beat me almost to death while I was living in Milwaukee. I had no firearms at that point. That will never happen again.
If you destroy the sanctity of my home, you will die. It has nothing to do with "testosterone" or whatever lame excuse some of these bleeding hearts try to argue. It's protection and honor, plain and simple.
If you don't have the courage to protect your family and your home, then you don't deserve that family and home. This is America, you never know who has a firearm. If you're breaking in my house, then the assumption is that you are locked and loaded. Every state should allow you to protect you and your family.
