Because this movie is badly written, not thought-out at all, badly researched cash-cow, and nothing else.

It's an austin powers movie. How much research is really needed. The Movie itself pokes fun at the lack of logic in the second one. They even recommend not thinking about it to hard, and just enjoy yourself.

Excuse me. Care to name what evidence would hold up in a tribunal that would convict the head of Virtucon, the legitimate wing of Dr. Evil's operation, and his son who just lives with Dr. Evil, and Scott's mom, who probably also works for Virtucon.

Austin Powers movies are good-willed and -tempered comedies. Just go with the flow. I can well imagine that Myers and Jay Roach (the director) had adventures as hippies in the 60s.
