Kessler arrested at the end??

I just noticed right after Kessler pops Warren in the forehead the very next scene shows Kessler with his forearms up toward McAnn, as though he were giving himself up to be handcuffed. I suppose what he did to Warren was unlawful, but does anyone know if Kessler was supposed to be arrested at the end?

I'm watching that part now and Kessler has his arms at his sides, he doesn't have his arms raised. But, yeah, Kessler is definitely going to prison, for quite some time. Plus, with Warren being so reckless, Kessler wouldn't have needed to fake evidence in the first place. He could have arrested him and probably prevented those final women all getting killed.
