Just wondering. Why do something you know it's illegal in the first place? Did the guy who officiated the civil marriage not know about this? For example, nowadays same-sex marriages are still illegal in some countries so no one performs them as a result! And who told the police about their marriage?
They knew it was illegal there to perform in that state, but did not know that if they legally did it in D.C. that they would still be charged for a crime. When same sex marriage became legal in certain states, you could get married in another state, but if you went back to a state where it was not then your marriage just wouldn't be recognized. You could still live there and not be charged with a crime.

The main reason I think he wanted to legalize the marriage was that he probably knew his children were going to suffer the massive racism of the times then and he did not want his child to suffer even more by being considered a bastard (child out of wedlock). That is probably why he wanted to get married legally after she got pregnant. The scene where they talk about what the defense would argue was that the marriage should be nullified and their children to be declared bastards. He did not want to hear that so this is why they did not attend during the supreme court arguments.
Because they loved each other and wanted to be together, plain and simple---which should have never been a crime in the first place, simply because of something they had no control over---their skin color. And those laws saying that they couldn't get married were old,outdated and racist as hell anyway. There;s never been any real logical reason as to why people from two different races couldn't get married. When you really think about it, those laws really didn't make any real logical sense whatsoever, and were only based on the racist fears of white people,who made those stupid laws,period. You make it sound like they shoudl have neve rbothered to get married---no, those stupid racist laws had to go----that's the long and short of it.
In addition to what others have said, they lived in a tiny rural community in which the races lived and worked together and in which there were a lot of mixed-race people. They didn't think anyone would be bothering with them.
