they're fighting, but obviously not trying to kill or seriously hurt each other.

I mean, toward the end the bits with Tony+Cap+Winty it might change, but overall...

I never understood this criticism. If former teammates and allies had to fight one another, would you expect them to start stabbing and shooting each other from the word go? It goes against their characters. That's one of the reasons why a lot of the fans hated the original comic story.
