What they leave out


It's true that with a K-1 visa, you have 90 days to marry your partner after they arrive in the U.S. What they leave out is that after you marry, your foreign partner is not instantly awarded the visa. You still have to go through the difficult immigration process and prove to USCIS that your marriage is bona fide, which requires collecting and disseminating all sorts of evidence and attending an in-person interview with your spouse at a local immigration office.

I can't imagine most of these couples are successful in proving their marriages are legitimate. The K-1 visa was established during the Vietnam War so that members of the armed forces who met their partners while serving could easily bring them back to the States with them. It wasn't intended for down-on-their-luck loners to import con artists who they met on shady dating websites.

Especially Mo and Dani with them living apart from pretty much the beginning of the marriage. He really should have to go back.

That's what I don't get?? Why did Mo waste all that time, just to split right after the wedding? If their marriage is a sham, he'll be deported. It doesn't make sense. If he wants a green card, leaving your wife 2 weeks after the wedding, traveling all over the US without her, and starting a new life in a different state doesn't seem like a smart move.

Unless - if Mo can prove that Dani is the one who lied, can he somehow still get his GC? If he claims she lied about finances, or that somehow his home life with her was toxic and unstable, can he still be allowed to stay if they divorce?

Requirements for green card are pretty much the same as requirements for K1 visa. So if K1 visa was approved and they got married within 90 days, spouse will most likely receive a green card too.

K1 visa requires all types of verification and the interview at the American embassy in a country where the person who's applying for K1 visa lives. So its not like everybody gets it.

However, there are two green cards. The first one is good for only 24 months. After those 24 months, the applicant must submit verification all over again that marriage is real and has been real.

Mohamed regardless got his greencard and his scam worked in his favour so clearly the K1 visa has major loopholes. Any immigration officer just watching one episode of the show could see that!

He got temporary green card. In 24 months that green card will expire. If he wants to remain in the USA, he needs to re-submit the application with proofs that his marriage is real - so joint tax returns, joint loans, joint leases, joint pictures, etc SINCE DAY 1. Oh yeah, and Danielle will also need to sign the application.

By the way, there is no immigration officer for the green card - its all done via mail. And for the interview for K1 visa, only person applying for it (in this case Mohamed) goes for the interview.

Really?I always pictured it being like the movie Green Card..the couple parted sitting in separate rooms being asked the same questions..

It's true that the for the actual K-1 visa interview, only the applicant is required to appear (not the USC fiancée). However, once inside the USA and married, after filing for adjustment of status (green card), after some months of processing, both spouses appear for an in-person interview with USCIS. Lately there have been cases where the in-person interview is waived. The in-person interview is not like in the movie Green Card, where the couple is separated and asked personal questions. They are in a room together with a USCIS officer, and the questions are very straightforward. If all gets approved, the foreign spouse gets a 2-year conditional green card.

At the almost 2-year mark, there is another form to file and evidence to submit to remove the conditions and receive the 10-year green card. If still married, both spouses must sign the form. Usually these are reviewed and approved without an in-person interview.

If the couple gets divorced during the 2-year conditional period, the foreign spouse can file for removal of conditions as soon as they have the final divorce decree. They must provide evidence that the marriage was entered into in good faith. Sometimes these cases involve an in-person interview, sometimes not. If an in-person interview is required, only the foreign spouse appears, not the USC.

Actually my wife got her temp 2 years green card and her 10 years green cars without any interviews - everything was done via mail. For her citizenship she had to take a 10 questions test, but no interview. I didn't had to be present for any of these - I just had to sign her paperwork.

I know the Mormon 40-ish guy and his beautiful young wife proved that.

I'm sorry but isn't that one in the same? A lot of Vietnamese wanted to leave their war-torn country, and what better way to do that than marry an American. To me, both scenarios are similar. So, if you're going to harp on one, you'll have to harp on them all.
