Maybe nobody murdered Danny, maybe it was an accident. But someone found his body, was certain, that he was killed by someone close and tried to cover it up. Maybe Joe found him and thought it was Tom. Maybe Tom smashed the computer, because he thought it was his father. Maybe Vince thought it was Mark. Maybe Danny's message - it was someone close to home - meant, that it was himself. Maybe they are all innocent.

They both feel guilty, because he's dead. But it was an accident nonetheless. Nobody killed him.

Do you really think Joe wouldn't have killed him, if Tommy hadn't just popped out of nowhere? Joe was trying to stop him from threatening to tell.

Joe was trying to stop Danny from jumping or falling from the rock. There were no signs of Joe's attempt to hurt Danny.

Legally, it was murder. I started a separate thread on that subject.

I'm a retired attorney who served as a defense attorney and later as prosecutor. I'm not making this up.

Legally, it was murder. Joe was the perpetrator of two felonies (or attempted felonies).

Depending on the interpretation of evidence, it possibly wouldn't have been considered premeditated murder. But Joe is still responsible for Danny's death and would be held accountable by a court.

It doesn't have to be premeditated.

It doesn't have to be intentional.

It doesn't have to be the product of an act by the defendant.

If the defendant engages in a predicate felony or attempts to commit one, and someone dies, it's first degree murder.
