So they allowed to rip off Marvin Gaye??


But when Robin Thicke does it he gets slammed in the media and sued!?? Bit of a double-standard, don't ya' think?

The song in the last episode was even ripping off lyrics, let alone the sound.

First, Pharrell and Robin initated it because they sued the Marvin Gaye family first to get a judgement to state that the song was not copyrighted after the song became a hit. They lost because they produced a hit song that had similar elements to a copyrighted song from an arist they have stated influenced their music. Whether they knew or not, by law they needed to get permission from the persons who owns the copyrights to that song before they can reproduce that song in any way. In addition if they do, they also have to share any type of the royalties from that song to the copyrighted party. They refused to do that even after the verdict which was why they were slammed. Not to mention Pharrell and Robin sued the party who owns the copyrighted song first which made them look bad. Not only that Pharrell and Robin refused to settle out of court like most copyright cases. Instead they chosr to drag it out which is rare. Basically as long as you are given expressed written permission from the party you can use their song. Even then you are still at their mercy in terms of a lawsuit. Sometimes some people wont care until it becames monetary or commerical. In any case copyright cases are hard to win if youre sued for it.

I agree there would have been no drama if Pharrell and Robin had simply followed copyright rules. They didn't, so they got what they deserved.

Exactly. Many song sound like others and are derivative, but on a TV show this legal stuff is taken seriously.m Plus if it real stole from Marvin Gaye, his family would've sued them as soon as the show aired.

they didn't lift the music.... I'm saying they copied it (emulated it).... And they copied it far worse than Alan Thicke did.

Its the song the girl sang when the gay brother had a panic attack.... And the Marvin Gaye song they copied was What's Going On.

So no... they didn't get permission, because they weren't re-doing the same song... They were biting off it.

I'm just saying, the Gaye family is so sue-happy... when then... be consistent.

Umm, perhaps Lee Daniel's did it right through the proper legal channels and received permission and the Estate of Marvin Gaye was paid for allowing it.

Robin Thicke didn't bother to do that.

There's no way Lee Daniels got permission either.

You think he was like, "Hey... can i make a song in the show, that sounds nearly identical your estate's song, but it isn't the song, and so i won't have to pay you?" and then they were like, "Sure.... i mean, you're black, after all. Why not? We don't care about money".
