How did Francis got away with it and how the guy turned up in the protection of Narcisse?

Narcisse and his thug had Montgomery held prisoner and Bash found out through the priest they also held so Bash and Francis rode to where Montgomery was being held and had him sign a paper. When they realized the guy was still gonna talk, Bash stabbed him.
