So how did they get away with a Death Star in this movie?

Was it an homage, or because Bad Robot has some sort of rights to images used in both movies, or something like that?

(I do realize that on the actual structure that's more like a nipple than a cup, mind you.)

A low res polygonal sphere with a circular ring on it is a common shape, doesn't mean it's a Death Star
