Ben's guilt

We see Ben go free, but isn't he really guilty because he knew his girlfriend killed his sister (by choking her) and didn't say anything. Isn't he an accomplice to murder, a co-conspirator so to speak. Most cop shows I watch would say yes. Anyone else notice this? Or did I miss something?

I'm sure even they did want to prosecute they would consider time served. He was in prison for 30 years which is more than enough for an accomplice charge.
