When Nicky is describing how he gave Jess the necklace with the mic in it and we see Jess walk by Gariga and put the necklace in her suitcase... if they weren't dating why would her stuff be in his room? Did I miss something

What you saw was Nicky's lie, as it would have looked had it happened. Nicky was trying to cover for Jess, so he told the lie about the necklace. As he tells the story, we are seeing how it would have looked. It never happened.
