I found it ironic that MCC's angle on Washington's death ( make Bailey into a villain) was exactly what the inmates wanted - or at least the black inmates who knew her well.
Caputo did the right thing as Bailey was simply in an impossible situation due to extremely poor guard leadership. The end of the last episode highlights that we all want justice and vengeance when an innocent person is killed.
True, but from the characters points of view, nobody actually saw what was happening. As there was so much commotion in the room, you had inmates standing on the tables, inmates getting pulled off the tables, plus all the commotion that was going on, especially when Suzanne was attacking Bailey, most of the characters didn't have a clear view of what actually happened.
Taystee only saw Poussey's body on the floor when she got down from the table and realised that it was because of Bailey that she was in that position / couldn't breathe. But, from Bailey's point of view, he was trying to protect himself from Suzannne, plus protect Poussey by getting her on the floor, obviously not being aware of what he was doing at the time with Poussey beneath him.
Bailey wasn't strictly a villain because he was trying to protect Poussey, he just went about it the wrong way. It was manslaughter really.
While I do agree that it wouldn't be right to make Bailey into a villain per se, I also think it's wrong that they only gave him extended leave as opposed to firing him. Sure it was an accident, but that's a really bad accident. He can't be excused for killing someone just because he wasn't trying to.
What Caputo should have done was not to blame Bailey but say Poussey died due to poor management of the prison by himself, MCC and Piscatella. He did the right thing in not throwing Bailey to the wolves but he did not acknowledge that Poussey's death could have been avoided and the prison as a whole was at fault. But that seems fairly typical for Caputo, he's not evil but he looks after his own skin to a degree.
It is a difficult situation, where neither party did right or wrong. Caputo did the right thing not to throw Bailey under the bus, but at the same time he forgot to also put the spotlight on the victim, that's why I think they put so much empathy on him not even mentioning her name.
