Miller's story is brilliant BECAUSE of precisely this. Superman is the "bad guy" because we see the story from Batman's perspective and yet we see the necessity for what Batman does at the same time.
Both character's are good guys operating under a different set of rules of engagement and this is because the people (us) are so indecisive.
Robin's parents are Miller's disdain of the 'hippy' culture that hates the police and sit around wishing people would be good but they never are. The Joker's psychologist is another textbook stereotype of weakness to crime by crying for the criminal and not the people the criminal kills. The mayor is impotent because the people want crime stopped but by non violent ways (diplomacy with barbarians).
If you want a villain, look at the people of Gotham city.

You are aware that Batman wins the fight with Superman, but that Superman wins the war? Batman, in the end, leaves behind the Dark Knight persona and begins teaching and training the locals in how to fight the war against crime from the shadows so that the people don't get all worked up about it. In the end, that's all Superman wanted, to not, "Remind them [the people] that Giants walk the earth."
