we can make a case based on the grounds of poor acting, directing, and writing in this uninspired straight to video drivel!

Why would anyone be sued? It was well advertised as an 'authorized ripoff'.

I don't see any need to sue. If any film is successful, you can bet there are going to be dozens more just like it. Just look at the 1980s with the success of Friday the 13th, a whole decade worth of slasher films were made right after it and I don't think that's a coincidence. Even earlier than that loads of possession films were made after The Exorcist. The same thing happened after the success of Scream and now it's happening after the success of Paranormal Activity. Just wait for the next huge horror film that will start a trend of imitators all over again.
