To add to this.. The film makers of 'just go with it' openly acknowledged that it was based on Cactus Flower and the prior plays to that in the credits. They also give writing credits to those prior writers. They aren't hiding this fact at all.
The Indian film copied the same people and didn't give any credit at all. So if this is a scene-for-scene remake then at very worst the two films are even in ripping someone off and not giving credit.
