I don't agree with families separating no matter what. I was actually watching this movie with some relatives from another country and they said that people deported there would deport the whole family since its assumed that they would follow their primary caregiver even though they were citizens, and they would be welcome back when they are of age. I can't possibly imagine leaving my 5 year old behind if I was deported. I wonder if taking your kids is even an option in the US, since you hear about so many families being split up.
The only reason I could ever see to leave your kids behind was if you are planning to try to sneak into the country the second you get back.
You guys have to think past the drama that comes with splitting families. Nobody wants to separate families...
Laws are made to control the flux of immigration.
If you didn't punish people for this then whats the point of getting a green card. You could just raise a kid. The only people who i feel bad for are the green card holders that forget to re-apply. yes its their fault but sometimes they don't understand the immigration paperwork.

they can deport a father/mother that has a american-born minor, sometimes they deport the minor as well, and sometimes they just split them and in the case they have no one they may even send them to foster homes
shareThe immigration lawyer in this movie gave horrible advice. ICE can and will deport people who have US citizen children, but the father could have at least applied for a form of relief called cancellation of removal. He probably could have bonded out of detention while waiting for his hearing(s). If I remember correctly, he would have had to show 10 years of presence in the US plus "exceptional and extremely unusual hardship" to his US citizen child if the father is deported. Since the child didn't have a mother to care for him, I thought this was at least worth trying (though "exceptional and extremely unusual hardship" is a very high standard). Asylum, which is what the immigration lawyer talked about, would have never entered the picture in this case.

If a person carries that fear in the back of their head, it seems they would be paying attention to what people are saying.
A prudent person would plan and make contacts.
Of course it makes a stronger movie to ignorantly take the first Lawyer in sight and trust they care and know the best way to do what needs to be done.
USCIS hates to split families. That's why they prefer to deport the whole family altogether.
