Grab bag with regard to Russell

Dick #2 has a new expert to add to his stable of “Let me call a buddy of mine” appraisers:

The type of counseling Russell will undergo wasn’t specified. John Pacult, the Las Vegas licensed clinical social worker named in the plea agreement, didn’t immediately respond to messages. However, one of his specialties is counseling sex offenders, according to his Internet website.

Russell can no longer possess firearms as a convicted felon.

Will Russell be able to “work” in the pawn shop that has armed employees and antique firearms in its inventory?

Antiques and Replicas
Nevada statutes are silent on antique and replica firearms. They are treated as ordinary firearms for possession and carrying purposes.

Nevada law prohibits the following people from carrying, owning, or having custody of a firearm:
• People convicted of a felony in Nevada
• People convicted of a felony in any other state
• People convicted of a felony under federal law.

The exception to this rule is for people who have been pardoned, but the pardon must not limit the right to bear arms.

A firearm is commonly understood as a gun. Las Vegas law defines a firearm more technically as “any device designed to be used as a weapon from which a projectile may be expelled through the barrel by the force of any explosion or other form of combustion.”

Which defenses are most effective for fighting allegations of violating NRS 202.360 depend on the circumstances of the case. But the following are common strategies a defense attorney may use in Nevada:

No ownership or possession: It is not a crime for a convicted felon to be in the vicinity of a firearm as long as he/she does not possess or own it. If the defense attorney can show that the defendant had no knowledge of the firearm, then charges for being an ex-felon in possession of a firearm should not stand.

Is it safe to say Russell won’t be involved with any purchase of firearms, cannons, or any device from which a projectile may be expelled through the barrel by the force of any explosion or other form of combustion at the pawn shop?

Olivia Black poses for nude photographs and is fired from the Pawn Stars show. She continued to work at the pawn shop for a short time after that. She filed a “law suit” against unknown entities for her dismissal. Status of that “law suit” is unknown.

No word yet from the History Channel, Leftfield Pictures, or the Gold and Silver Pawn Shop on whether a convicted felon and admitted drug user continues to be employed.
