So its pretty obvious he killed his wife. But why the hell is he not in jail then?

As obvious and clear as it may look, the police need physical evidence to show the link between him and his wife's death. They never found the body so they failed to find the cause of death. As stated in the end of the film, she is considered to be missing not dead.

I agree with ET, there just wasn't enough evidence and rich people have a way of making things go away.
