Okay, so that Clive guy who was trying to shut the factory down said in a part that he was 45, and Fred is older then Santa [Nick] and cant be older then 45.
Yet, Nick [Santa] said Clive asked him for a gift, but how could that be?
He couldn't have been Santa at like 5?

Remember, at the begining it said Nick, and his family, turned immortal when he became Santa. So, he would have been the age he was.

Because he was too stressed out. When we first see him we see that his wife (played by Miranda Richardson) tells him that. He also overeats due to stress, hence the weight issues throughout the movie.
shareGood point, kanimaki. You know, Paul Giamatti did a great job in showing those signs of stress rather than just being the "jolly old elf" we usually see. He brought a lot of humanity to the part. And then when he does blow his top during the snowfight scene...
There's a lot that's easy to miss in this movie.

That could get weirder and weirder. Fred Claus is probably hundreds of years old, and he's never been married. In his long life, he's probably been part of dozens of very sad, weird, sci-fi love stories.

shareIn the beginning it explained that once you become a saint, your family - including spouses, turn immortal. And right before Fred calls Santa from jail, Santa was complaining to his wife how he had no more grey hair but premature white hair.
shareWhite hair and a full whtee beard will make anyone look older. However, Fred's ribbing Santa about having trouble getting his sleigh up didn't quite make sense as Fred appeared to be quite virile although older.
