I know that the movie would have never started... but was there a reason if the house was his that he didn't get a *beep* and kick her out?

EDIT: OK half way through the movie you find out that they can't afford the condo alone, either of them.

When did it mention that Gary was the sole owner of the condo?

They bought the condo together which is why neither of them moved out.
