Jo will probably lie in court

when testifying saying she was being assaulted and Alex just defended her.

At the spur of the moment, Alex may have though that anyway. I know people say it was clear she was laughing, not crying, but when you walk in if he thought she was being assaulted, then just snapped into a fit of rage, that might make a good defense. Actually all his other past fights might even help his defense.

I'm not sure she would or could. Delucca knows her secret and right now she is pissed at Alex. Also unless she legally changed her name, if she is under oath, she would like about her name. Or she may be afraid with the publicity her husband could find out. But unless they strike a deal, she would have to testify, so I see her begging DeLucca to drop charges just so her secret does not get out

She would have had to legally change her name to have a license to practice medicine. We don't know when she did it. Maybe she married really young, before going to med school and changed her name before then. If I remember correctly, she testified at Callie's civil suit hearing. So, she has already testified under her name.

If she was smart enough she'd tell the truth. In the heat of the moment,Alex really didn't have any idea what was going on. Does that excuse him? absolutely not. But him snapping without thinking and jumping into action totally its with his character and his past, which is one of the few things I like about this plot.

Sorry, but that wouldn't hold up in court. Snapping into a fit of rage is an excuse to let him beat Deluca have to death when he was in a situation he had no idea about? I disagree, sorry. His hotheaded and unpredictable past will not help him at all. I not a lawyer or anything close but that's just my guess.

I'm more of the side that I can't understand how Alex would come to that conclusion that she was being assaulted over hooking up. He didn't know she was drunk, he didn't see her stumbling around/slurring her words, nor did he know that she'd just come home from the bar. If he smelled alcohol, why would he assume it was just her who was drunk and not both. She was laughing, plus they'd just had a fight that was a possible break up fight so her lashing out and sleeping with someone else seems far more likely. It seems to me like he saw she was drunk after the fact and used it to justify his actions. Unless they show a flashback scene or something where Alex runs into Stephanie and she says Jo was totally wasted and Deluca took her home or something, I can't see how he can possibly justify that he thought she was being attacked.

As for Jo lying on the stand, I think that would make her character totally unable to be redeemed for me. She would not only be lying on the stand which is bad, but she would be making an accusation about a man who is totally innocent and was really forced into helping her in the first place. She would be condemning Deluca to the accusation that he, a totally nice guy who is blameless in this situations, was an attempted rapist and that is just absolutely awful.

If she claims it was Delucca going after her, then he could tell the truth about her being married so I don't see her saying anything. I think it would be better for all parties to not have her testify at all

reply

Yeah that's another thing too. He has a bomb on her.

That said, I can't imagine that she wouldn't testify. She was a key witness. Hell, she's the only witness, and she's a vital part of the scenario.

I just hope they don't have DeLuca drop the charges.

reply

I hope not. I'm not one that's "pro"-Jo or "anti"-Jo, but I just don't want her to lie.
I'm waiting to see if the prosecution brings up Alex's violent past and uses it against him.

reply

I think his past is what earned him the felony charge. Bailey said they subpoenaed his employee file and he would have the attacks on his brother and Shane in the file.

Thanks ictrebel. I figured as badly as Deluca (sp?) looked and was injured, it would have been a felony as is.

reply

Not necessarily, especially after looking at how assault is defined by law in WA state. http://www.odamalaw.com/assault-charges-misdemeanor-felony

They have to show intent to cause harm and they would have a hard time proving that I think. Alex reacted to what he perceived happened. It will be interesting how it plays out.

I agree.

I was surprised that Alex thought Deluca was assaulting Jo. I heard her laugh and thought Alex even smiled as he was taking off his coat or tie (something like that). If anything I thought he was jealous that Deluca and Jo were in bed together and THAT'S why he attacked him. So it was different to hear his take on why he did it.

reply

I heard the laugh, but maybe Alex didn't. I think he smiled when he walked in as she was there, then it registered on his face DeLucca was on top of her.
Alex has 3 switches
1. Where he can be understanding, loving and great with his young patients
2. Flys off the handle at the slightest provacation
3, Protective and patient of those he loves

He is responsible, but there are mitigating factors they can argue. Whether they will go there or if he decides even though he is hurt and angry at Jo, he may still protect her

Since when does GA go by real life situations?

They could always go with the Twinkee defense or my contacts were defective, lol
