He wasn't arrested to begin with because nobody knew he raped her. She didn't tell anyone for all those years. Young Bobby saw her getting raped but didn't do anything and made himself believe she was just having consensual sex with the teacher. That's also why he was crying in court, because he knew what happened and didn't do anything.
As for the teacher, maybe he got arrested after the court fiasco but it wasn't shown, but maybe statues of limitations ran out too.

What I dont get is how that sleazbag teacher knew he would be able to get away with the rape, how did he know she would not tell anyone and how did he know the witness would be too traumatized to report it? he just totally lucked out.
Plus if he was that kind of a person it makes me wonder how many OTHER victims he had.
To be honest when a rape victim does not report their rape I end up feeling a degree of hate for the victim. I know that sounds heartless BUT to me it is the ultimate act of selfishness to be a rape victim and NOT report it for this reason: The rapist will almost certainly seek more victims, and I consider anyone who does NOT report him to be partially responsible for that. If the person had been reported on their previous victim (unless you are the very first) than you would not have been raped. So every victim after he rapes you is morally partly your fault if you do not report. I hold the main character of this movie responsible for any other rapes that occurred after her rape.

Pluse Josey was really young when it happened so you really can't blame her for not wanting to tell but then again she coulda shut down that teacher. I think she should've told when she got pregnant. Also I think the parents should've suspected something if she just showed up pregnant and said she didn't know who the father of the child was. I would be like what the *beep* you mean you don't know. Then it would make me wonder like what is really going on with her.
But a young girl wanting to hide a rape is believable.
I doubt the teacher was arrested, statute of limitations.

A lot of rape victims are abuse victims (from childhood). They are professional victims who are somehow "scouted" by professional abusers. It's like they know the "victims" are damaged and won't tell. Professional victims also have bad judgement of people and are attracted to scum (because they were raised by scum). That's why these victims need tons of therapy, otherwise they'll be victimized over and over and over again. Professional abusers also need to be taken out of society and not allowed to breed.

The statute of limitations in Minnesota for rape may have already expired by the time he was summoned to court. Because she never told for the longest time, he may have got off scot-free because of it.

So, the entire teacher thing was fabricated for the movie. It was a dramatic way to show the women uniting behind the plaintiff. Apparently the idea of a date rape wasn't dramatic enough.
Yes, as some posters have noted, the subplot is somewhat preposterous. A teacher is not allowed even a consensual relationship with a student, and therefore the notion that he thought he could rape a girl right in his classroom, against the glass door no less, or that she would allow him to get away with it, presumably returning to his class as if nothing had happened, is yes, somewhat insane.
Either way, people are putting too much thought into it because it never happened.
The obvious upside to the subplot is that it allows Amber Heard to be in the movie, perhaps one of the only women on the planet capable of realistically portraying a young Charlize Theron.
Your reasoning makes no sense. Obviously this story is made up, but it's certainly a composite of things that have occurred in real life. A teacher could never rape a student because it's "not allowed" and "not consensual"? There is a difference between forcible and statutory rape, even if the forcible rape is against a minor. Why would ANYONE think they can get away with rape? Only because it happens all the time, victims are shamed and humiliated into silence, and conviction rates are startlingly low, and when assailants are convicted, sentences are often very mild and do not reflect the gravity of the crime at all--like a suspended sentence, time served--fitting punishment for a brutally violent crime that will likely alter the victim's life, sense of self and personal safety, etc. for the rest of her life? No, it's really not. A year or two in prison is not enough, either.
Bottom one is, this may be a movie teaches have raped students in real life, not just as "consensual" but still illegal sexual relationship with a student--I mean violent attacks. So often, victims are up against so much more than the assailants that the thought of having to deal with it is almost as horrifying as the rape itself. The way victims are treated by community is another thing--some are harassed or blamed for their own assaults. Some cultures prefer to "work it out" between the families involved, which basically always means making the victim "make up" with her attacker, agree to forgive him and pretend that it's all some silly misunderstanding.

No one ever said teachers never rape students, whether forcibly or via simple statutory rape. We all know both male and female teachers have and continue to.

Is it conceivable he thought he was untouchable and could do whatever he wanted in his own classroom? Is it possible that he truly believed she wanted it and wouldn't report the crime? Sure.
Yes, it is even conceivable that she would feel so humiliated by the crime that she wouldn't tell anyone, and that she would simply return to school like nothing happened. Conceivable, I guess.

Some girls dont speak up about their rape attack because they're concern about their reputation and others because maybe they participated in a group party that involved alcohol, drugs and weed/marijuana so they wont be able to claim to be a victim and depression/alcoholism will not help ease the pain.
