Even though they got their money back, Dick will still be indicted since Jack doesn't admit to stealing the money from the company. Not a much better outcome for Dick.

indicted is still a long ways away from a conviction. They would still need to prove he had anything to do with it beyond a reasonable doubt to a jury.
