Nothing is really said of how long Chloe' was in there...according to what we learn in the film, she killed her father to end a long standing cycle of sexual abuse. Assuming she was very young (perhaps in her teens-or late teens-old enuff to be tried as an adult even as young as 15 in some states) She could've been released on parole. However, my theory is this. In some instances in crimes such as this, an insanity plea might be pursued but the individual could be found to be unfit to stand trial and automatically incarcerated in an asylum for the criminally insane until the defendant is deemed fit. However, a "temporary insanity" plea is totally different and if the defendant is fit to stand trial- depending on the nature and motive of the crime, that defendant can be found not guilty and released. The movie doesn't hide the fact that chloe' is mentally compromised, which is why she is in therapy. A life such as hers it's little wonder why she is deemed insane..add to that the fact she is being raped while in the facility but is construed as an "embellisher" and not taken seriously when trying to express what she's going thru. How can she be believed when given her mental health she can't associate a reality if she can't see her rapist other than an evil tattoo seen in random flashes of light in extreme darkness. (hence why she refers to him as "the devil") Again, since there is no concept of chronological time in this film, After it is discovered that she is in fact telling the truth of more rapes i'm sure after much more therapy and a proper trial the motive is such that with an agreement of continued psychiatric treatments on an out patient basis, she would be allowed to be released.
