I see that Jesse Friedman also filed a defamation suit earlier this week against DA Rice and two others in her office: www.courthousenews.com/2014/06/23/68937.htm. Off hand, I'd say that that suit has approximately a zero chance of success.
If all this was an attempt to tar Kathleen Rice right before yesterday's primary election, where she was seeking the Democratic nomination for a US House seat, it didn't work -- Rice won 56-44 over her opponent.
