Why wasn't Nathan A___ tried for treason after the battle?

Treason to who? He wasn't a citizen of Japan or a member of the armed forces either, so who did he betray? His commanding officer is also dead so that helps him out. It's also possible the emperor pardoned him of any crimes after the deal was called off.

Timothy Spall's Simon Grahm's narration at the end hinted at several possible "endings" for our hero and we get to see the one where Algren returned to the mountain village.
