When the doctor tells him that he's going to be executed unless the "killer" personality doesn't survive he had already explained to the others how many personalities Malcolm has. So no the cop wasn't one and the dead motel owner wasn't. Only the ones with the same birth dates and names after states.
I just got through reading trivia and originally the guy at the beginning that's getting the birthday sundae eaten off his chest is the same guy that Rebecca DeMornay is talking to on the phone (her agent). Well, he was suppose to be the first one of Malcom's personalities to be killed and then they decided to cut that out. He had 11 personalities and they're all listed under trivia. So you can read them there.

They were all personalities. In the beginning the doctor is crossing out "Personality 13" and "Personality 12". We don't get the names of the hotel owner or the cop, but the doctors were already taking measures to wipe out the personalities. Only 11 were alive to meet at the hotel. Anyone who interacted in the mind of Malcolm Rivers were personalities he created. After seeing the movie, you kind of need to watch the beginning again to hear the tapes the doctor listens to, see the articles the doctor is reading and see his notes. This movie had more twists than anyone was prepared to comprehend. You would also notice Malcolm's mother's name was Callie, possibly leading to his use of state names for everyone else. Watch and see if there is any way to get the name of the cop transporting Rhodes and Maines or the original hotel owner prior to Washington's take over of the hotel. More states are represented within their names if you pay attention.
