What if Dave had just said after the Marshall had said "Calm Down" Dave had just said, I'm sorry, I'm being calm. "I just don't understand what the whole issue is here, I'm a little puzzled.

Or was it all planned? And was the Judge in on it too?

It was planned to get him into Buddy Rydell's class. He basically explained it to Dave at the end. Nothing David said would have gotten him out of that situation.
