Does anybody even care about Hector


The girl portrayed by Bijou phillips claims that she was raped, when she really wasn't. Afterwards, you see hector being arrested and wrongfully accused for rape. As a matter of fact when they asked them to stop that night they were having sex, they did stop, but becuase hector already had a criminal record and maybe to poor and ignorant to use the drug money to pay for a lawyer, the cops decide to arrest him anyway. Hey, hector never asked for these rich white girls to come barging into thier lives. These girls invited themselves in, by asking to be apart of their gang. I thought that was messed up and I'm am very sure it happens frequently. I have witnessed injustice like once or twice.

If it aint moving, you can eat it!

Point is: Consensual sex does not make a different when a minor is involved and even the girl said no, yes, no, a case could be made she said yes because she was fearful to say no. Either way, she said no and that's all it takes during trial.

If Hector made as much money as he said he did, he would have been fine with a lawyer. If not he would have been represented by a public defender. In any event, he would have been charged with rape and sentenced to jail.

This is not injustice, this is common sense.

This is inaccurate. The law says people below a certain age are unable to consent to sex, however...Statutory Rape is not treated the same as a violent, forcible rape. Not every Statutory Rape case is prosecuted, and this is why there are usually harsher penalties for forcible rape/sexual assault than Statutory Rape. Statutory Rape in California is important because of the high rates of teenage girls getting pregnant by grown men. And I fully support this law because i know from experience how easy it is for a 25 year old man to woo a gullible teenage girl.

However, we aren't talking about a man who had consensual sex with a minor. Emily apparently made the claim that she was "isolated" in a room and was attacked by Hector. Not anywhere near the truth. She wasn't targeted, isolated and forced to have sex against her will. She harbored no fear of repercussions if she said no. She was willing to have sex to get into a gang, rolled the dice and was happy to have sex with three men.

Not even remotely correct. Emily was crying out in pain, something I suspect they expected her to do during this "initiation" Once she panicked and freaked out, the jumped off. They were confused and angry, but they left and let both her and Allison leave. This isn't something rapist do if their intent is to rape someone.

The people like quiksilva34 trying to convince us it was rape are not confused, they are just motivated by racism. It's very clear the ppl on this board claiming to be "law officers" or "students of the law" are well off white men/women. If a poor and underprivileged hot Latino girl was escorted to a frat party for some ivy league white college students and the same event occurred, the girl's pleas to the cops would be ignored. As they should because the girl's story was completely fabricated and the guys didn't rape her.

The rich white college guys would probably have even waited longer to get off the Latino girl. The reason I say that is because in both cases, the guys knew the girl was naive and out of her element so they didn't respect her, but in the case of what we saw in the movie, the gang members had enough sense to know that some rich white girls cry rape, so they stopped in fear of getting charged with a crime. Assuming the frat guys were sheltered and pompous, they might have even ignored her cries to STOP and just said; "cmon slut! I'm sure this isn't your first time getting gang banged", making that assumption only because she was Latino and poor.

The only reason Hector was charged is because she lied and let's be honest, a rich white girl's word of mouth against a Latino gang member is plenty of enough evidence for conviction. We live in a messed up world where the rich are allowed to get away with murder and the underprivileged poor are treated like rats that need to be exterminated. This coming from a white guy, thankfully I live in a city where all cultures are represented so I have an understanding of the trials that certain ppl face.

Umm, no, it was rape. Statutory rape as well as violent rape. And yes, Emily was crying out in pain, but she was also telling them to get off, which they eventually did, but certainly not right away. RAPE! The gangsters should have known that having girls have sex with them to be initiated is a dangerous game to play, and sooner or later someone was gonna call RAPE.

I agree. They should have known that some fickle little rich girl would cry rape to get attention. But they couldn't think pass their dicks. Being stupid doesn't translate to automatic rapist.

agree 100% OP not a depiction of rape.

Both girls willingly walked into that room knowing they were going to have sex with those men.

When Anne told Hector to stop, he did and got off her, clearly not the actions of a rapist. Now he didnt stop immediately, because lets be honest, sometimes no means no and sometimes no means a little more foreplay first. But they point is he stopped without forcing himself on her.

When Bijou cried out and told them to stop they not only got up they immediately left the room, clearly not the actions of rapists.

Now whether they stopped the split second the words came out her mouth or not they still respected her wishes and stopped. Your're telling me if a girl tells you to stop and you give two pumps and get off of her that's rape? Not only is that completely unfair to the male, its also one of the stupidest things ive ever heard. Women cant retroactively decide they were raped because they regret their decision, at the time it either is or isnt.

Now rape is a horrible action which only pathetic dicks engage in because they cant get laid, but regardless if your're already inside a woman and she tells to you to stop and you do thats not rape. I dont know why this is so confusing to people because to me rape is pretty obvious.

Girls came on their own. Agreed to have sex with any number of them (to join the gang). After one of them changed her mind, they let her go. The other WANTED to stay, she knew that 3 of them are gonna *beep* her. When she said no, they stopped, maybe not instantly but C'MON. If you're in the middle of it, and all of the sudden she starts screaming "no, no, stop!!" is it a rape ?! OF COURSE NOT. Just a stupid indecisive girl.

After reading this thread, I can honestly say I'm glad I'm not a young woman in the 21st century. Guys get away with way too much now. It's a pity girls let them, but to each her own.

consensual at first or not, it was definitely rape at a specific point. Those men were not stupid, they knew that these were two very foolish, naive girls who were not only drunk, but going along with what was being suggested to them because it was like they had a chance to prove they were 'real gangsters' or whatever, and not 'not real' like Hector so accurately observed. Those men never said anything about Emily having sex with them all at once, and she never agreed to that, as you can see when she says "I wanna do Hector first" - key word here, FIRST. That implies one at a time. And those guys never contradict her and say 'no no, all at once', so she never gets a chance to give, or not give her consent to that kind of set up.
So, what WAS rape here was the part where Hector beckons that other guy over, and doesn't ask Emily first. She probably thought that when the other guy jumped on (remember she's drunk) that she'd misunderstood the arrangement and was actually supposed to do them all at once, an that'd be why she waits a bit before realising it's not for her and telling them to stop. BESIDES, at that point she was clearly in pain and not enjoying it and we all know she didn't agree to have sex with two guys at once.
HOWEVER, I will say this much, kudos to the men for not carrying on when Emily tells them to stop, and also to Hector when Alison tells him to stop. It's just a pity Hector an his brother hadn't made their intentions clear to Emily then she would have a chance to say either yes or no, and either way there'd have been no rape at all. But of course, then there'd be no storyline. Also, Emily shouldn't have lied about the dice and the rest of the situation, but in a culture like this where women are 'asking for it' just because of the clothes they wear, you can understand why she'd be worried that her rape charge wouldn't be taken seriously if the police knew about those details. Not saying what she did was right, but you can understand why. It may not be very cut-and-dry, but she was definitely raped :s
