i remember waiting for it to come at and it never did, why?

Because the developer Mucky Foot Productions went bankrupt. The publisher Empire Interactive said that they were going to release it anyway, but then decided to cancel it. The poor box-office result of the film itself probably contributed to that decision. This project has been dead for three years.
