I'm guessing that was covered in the contract and couldn't be wished for. Yet knowing the devil, it still would have counted as a wish and Eliot's soul would have been doomed. On the other hand, if it was not prohibited, then the ending would have been similar, no? Except we wouldn't have seen what a good and selfless person Eliot really was nor would we get to witness the conversation between Eliot and the devil in the courthouse, which was a great scene.
