How Miles wasn't charged with Eddie's murder


In the beginning, when Miles' partner Eddie gets shot by Deacon, I was wondering why Miles wasn't charged with his murder along with the breaking and entering. The cops never got Deacon, so you think they would have wanted to pin Eddie's death on someone and that already had Miles in custody. I know its just a movie, but I was curious if you thought he should have been.

On that note, why didn't he get grand larceny as well for stealing the diamond? I mean, someone had to notice it was missing (although nobody cared to search the area where they arrested him). Breaking and entering plus grand larceny should've accounted for much more than 2 years of prison.

They can't prove it was him.

I figure if you have a good enough defense lawyer, you can pretty much work it out. There was obviously another burglar since police saw someone else zipline away. There was no gun and no diamond to pin on Miles so you figure this is the only plausible way to only get two years in prison.

But in real life, I'm sure the prosecution would have been able to pin everything on Miles. People have been put away for life because their sock was found at the scene of a crime. There's a 17 million dollar diamond missing, a broken safe, a dead body, a smashed cop car, assault on that security guard....the list goes on. Even the cops who messed up the evidence for OJ's case couldn't screw this one up.
