Not a goof (spoiler)


The way I see it, the fact that double jeopardy doesn't work like
people say in this film is not a goof, except in that it may be a
mistake by a character.

Libby is told about it by one of her fellow convicts. She got it
wrong, perhaps deliberately (in order to give Libby hope), perhaps
because she never really was much if anything of a lawyer.

Apart from that well, we know Libby believes what she was told.
Maybe she never looked to confirm it (it became her crutch, the
last thing she'd want to do is test it). But her believing it
is hardly a goof, particularly as we see how she came to believe
it (and from a source of unknown reliability as stated above).

The only other time double jeopadry is mentioned is when Libby uses
it to threaten Nick in the final confrontation. Travis confirms it,
to Nick, but he's just saying it to reenforce the threat. Travis
knows it's not true, and probably by that point he's explained it to
Libby too. The pair of them are just using it to put pressure on.

You make a good point. There are lots of other holes in the story, though. Such as an assailant leaving his victim with a gun she can use to shoot her way out of an unlikely coffin. I could go on....

However, Nick isn't really an "assailant." He's just a rich idiot who thought he could get away with faking his murder and framing his wife for it. He probably doesn't have the mindset to think like that.

Yes, the OP is right about it being a mistake by a character. She doesn't intend to carry it out.

But...

1. No Life Insurance co. is going to pay off for a murder.

2. What was that whole plan that Tommy Lee (Travis) stated of framing Nick for her murder the 2nd time, using the tape. Why even bring that up if it wasn't a plan? And how to actually pull it off, since Libby would never get to see her son that way?

Yeah there were a lot of plotholes. But Nick failed to check her backpack or he would have found the gun.

If he was in a rush I doubt he would search her.
