If you'll notice, one of Zorro's "things" is that he never directly kills someone (with his sword, with a gun, whatever). Technically, Rafael died from falling (although De La Vega aided that), and "Capitan" Love was killed by the gold from the cart falling on him.

I think, as you said, that Zorro doesn't kill people if he can help it (and since Rafael was going back to Spain, there was no need).
Whereas twenty years later... first of all, he'd had his entire life ruined by Rafael, so he was probably in a much less forgiving mood. And now that Rafael was the governor again, he couldn't let him live like he had before, or he'd be a hunted man for the rest of his life.
I don't think he was thinking "well technically I'm not killing him so it's OK." He could easily have stopped it if he wanted to, he just didn't want to.

OK, well, what I mean is that it is just a filming technique. It has never been stated as a personal preference of Zorro. It is just a cinematic touch with every Zorro movie ever that he doesn't directly kill people...at the very worst he causes the things that lead to their death.
Another example is the guy at the end of Legend of Zorro dying from the train collision. Yes, Zorro tied him up to the front, but that doomed the guy, it didn't actually kill him.
There's no real reason for it, it's just a tradition that Zorro doesn't kill people through direct means. He never shoots them dead. He just facilitates their dying through some exotic means.
