In fact, David could have called the cops on him after the street dispute where Walker jabs his finger into him (since he was smart enough to get Nicole to believe him then, the cops wouldn't have been hard to convince if the accused's own daughter believes it).
Only reason I can think off why he didn't call the cops was to avoid overplaying his hand (Nicole would only side with him against her own father so much) since his own criminal history wasn't enough to get a restraining warrant against him (we see Walker arguing with his lawyer about his options nonstop).
