How Does Cher Mess up the Legal Documents?


Hi:

Can anyone with legal/paralegal knowhow explain how Cher messes up the legal documents?

The encounter takes place towards the end of the movie while Cher is trying to help Josh & her Dad with a legal case.

Jerk Associate: What happened to the August 28th files?

Josh: Hmm? What?

Jerk Associate: Mel wanted them tonight. There were twice as many. He's going to go ballistic. Where are they?

Cher: I think I checked them for the September 3rd conversations.

Jerk Associate: What? Where'd you put them?

Cher: I divided them into two piles.

Jerk Associate: My God. I have to redo all that. What are you, some kind of idiot?

Josh: Hey, she didn't know.

Jerk Associate: She just set us back a day. Who cares about the September call? Now we're screwed!

Cher: I'm sorry.

Jerk Associate: Just forget it. Just go back to the mall or something.

Cher runs out in tears.


1. What did she do wrong? How serious of a glitch is it?

2. Why would she check a file on August 28th for a Sep. 3rd conversation?

3. Why does Josh wince & the associate freak when she says she divided them into 2 piles?

4. Why would she divide them into 2 piles in the 1st place?

For one keep in mind Cher is pretty clueless but i think she checked them for the sept3 call because just the day before remember her dad had her help him by highlighting all the sept 3 calls on the list? Her separating things in 2piles are just what she does remember when she's helping out for the disaster relief she tells mrs guiest she separated and made into 2piles entrees and appetizers? Hope that somewhat helps anyways that's how i interpreted it.

Well no one can know the exact details unless they know about the case itself, which we don't because it's never explained and not important. I work in the legal field, and I see the scene as they had some important documents divided into a certain way to work with/review, and she checked through them and accidentally divided them up - she thought she was making the documents more organized, but really they had to be kept in a certain order for the attorneys. Now they'd have to re-do the organization of the files.

As for why she'd be checking August 28th files for a September 3rd call - that always bugged me too! Again, we have no idea what kind of documents the "files" are, but that seems to make no sense. Maybe after her dad asked her to check some files for the September 3rd calls, she went further back and kept checking older ones for September 3rd calls? Cher wasn't dumb though, so unless she was distracted and mindlessly kept going through files not realizing the dates - who knows?

Anyway, the point is that it seems like it was a clerical error - she "organized" some files that now had to be redone. Not a huge deal, but given the stressful and time sensitive nature of the business, Jerk Associate was probably just overworked, very stressed out, and...jerky.

Let me, the lawyer, answer this question.

It looked like Cher, Josh, and the other guy (probably a junior attorney, contract attorney, or staff attorney) were doing document review, which is a process by which Cher's dad, an attorney with a client, has to turn over certain documents of his client to the opposing side's attorneys during a lawsuit via court order. I'm thinking that Cher's dad wanted her daughter, Josh, and the other guy to look for many documents with the August 28 date on them because they may have conversations that are either (1) privileged or partially privileged ("privileged" means private between the attorney (Cher's dad) and the client) that should be completely withheld from sending to the opposing side or partially redacted (i.e., blocked from view in certain privileged parts of the documents) before sending them over, (2) contain sensitive information that should thus be marked as "Confidential," so that the other side knows not to share those documents with a third party, or (3) incriminating to the client of Cher's dad, and hence Cher's dad would need to review those documents and come up with an argument to protect his client before sending those documents over to the other side's attorneys, who will surely use those documents against his client during trial.

And that lies the problem. Cher probably saw some documents with conversations that started on the date of August 28 and but continued on with less significant subject matter discussions until September 3. Instead of categorizing those documents as "August 28" documents, she categorized them as "September 3" documents, so now they have to retrieve those documents, re-categorize them as "August 28" documents, and make sure that Cher's dad has a chance to review those documents and see if they are privileged, confidential, or could potentially hurt his client. Basically, as the guy said, she set them back a day.
