I barely remember this movie, but this one scene is vivid in my mind. Didn't the bad guy (who I now know was played by Cary Elwes) get killed by drowning or was strangled by Kaa, the boa? I just remember a guy, a lot of water, and a snake in the water.

Yep, you remember correctly. :) He got knocked into the pool by Kaa after getting the bagful of gold, then he couldn't free himself and he sank to the bottom before getting nabbed. Hope that helps!

I find it irrelevant. I think Kaa was used here mainly as a symbol to represent evil. The serpent representing evil is as old as the bible.
This is why when Mowgli first encounters the serpent, it overpowers and nearly kills him, only failing to do so when Mowgli grabs the nearby knife. This is somewhat representative of his last fight with Cary Elwes, where he's nearly outmaneuvered and sliced to ribbons but for his last minute burst in reflexes. It could also represent how he is entangled and nearly defeated by the evil of the higher society in terms of the entire plot, but for the compassion of Kitty and the others.
Interesting theory on Kaa representing Evil, there are just two slight problems with it. First, Kaa was more a treasure guardian than an evil creature, the corrupt Boone guy (Elwes) took the Gold, he was decietful and evil, and so he died. Second (in Kipling's book...which disney may not have even read) Kaa was one of Mowgli's original tutors, not a villain. I do like the idea that you have though, good job thinking (not enough of that in the world sometimes).
I'm pretty sure Disney did consider keeping Kaa as a good guy for the original cartoon movie, but decided against it because Americans wouldn't accept a snake as a hero. Courtesy of the Bible, of course.
