I believe that is what the prosecuting attorney and state medical examiner were trying to suggest. The presence of semen on the corpse is rather questionable. Granted, it doesn't mean that he was murdered, but it is unusual.

Whilst the source of that semen is questionable, I doubt very much the defense lawyer's suggestion that "it could have come from a cow" . . .

Nowadays, it would be very easy to find out whose semen it was, but in 1990, I'm pretty sure all they could do is determine the species, and that it did NOT belong to someone.

The other issue with the semen is that nobody knows how long it could have been there for. I am assuming that it was on Bill's clothing and I doubt that that clothing was ever washed in a washing machine. That semen, which could have been Bill's, may have been there 30 years.

Questionable? Two men sharing a bed + nocturnal emissions - washing machine/personal hygiene habits = semen in odd places, even on your brother's clothing. No sex had to have taken place.

From what I remember, the incest theory was thrown around during the investigation but wasn't given much play in the trial. Without much evidence to go on, this would have been a risky thing for the prosecutor to emphasize in the trial, because it's so outlandish and hard to believe (even if it were true). With his signed confession, they didn't really need the motive.

Not to mention, it's irrelevant. Let's suppose the brothers often did have sex, and did so on the night Bill died. What would it change? Nothing. I think it was a pretty disgusting tactic to try to dig up that kind of dirt and it shows that the prosecution in this situation didn't handle things at all well.

Four brothers living together for over 50 years and were so introverted as to "not like girls" is weird enough already. They probably had semen on every article of clothing in the house.. err, shack... well, hovel. And the place definitely lacked a "woman's touch" (apologize for the sexism). Like someone mentioned, they'd never seen a washing machine.

I appreciate the fact that they must investigate each case with the same eyes. But was tax money well spent on this prosecution? If they had buried teh guy in the back yard, would anyone have ever noticed?
