that baffled me too, but as the film went on the only thing i could think of, is that lithgow's character didn't want the bullethole in his knee to heal correctly, so that when he escaped and killed jesse then shot him in the knee, with the dental records already switched, it made it look more definite that lithgow was killed in the crash

The only way he could have used his knee again was to force it to bend, so he used the books to bend his knee. It was the only way he would have been able to escape and get his revenge.
