There seems to be some widespread misconceptions about the copyright status of 'Night of The Living Dead.' While the film itself has apparently lapsed into the public domain and may be issued by anyone on DVD, or shown on television or the internet, the rights to the characters and story are still protected fully by copyright. This means that nobody may produce a sequel or new story incorporating characters such as Ben, Barbra, Harry Cooper or any other original characters related to the original script. Despite being the lawful rights owners, people either intentionally, or perhaps unintentionally, continue infringe on those rights. One such person is named Matt Cloude who is producing an unauthorized and amateurish "film" he calls 'Night of The Living Dead: Genesis.' This film does not only use characters from the original film such as Ben, Barbara, Johnny, Harry Cooper, Tom and Judy, he also names new characters after original cast members, naming a female character 'Billie Cardille' and having a 'Deputy Survinski' as well. Despite being warned by Image Ten that they were infringing on those rights, Cloude has continued to persist, even lying to his cast and crew about the situation. He is claiming that certain alumni from the original film will appear in this rip off, even though they have disassociated themselves from this project. Cloude has also show massive disrespect for the creators of the original film, even banning one of them from their Facebook page when he raised an issue about the project. Because of the original film's distributor changing the title from 'Night of Anubis' to 'Night of The Living Dead', but carelessly neglecting to retain a copyright notice, the film lapsed into the public domain, and despite the film being a commercial success, the creators saw very little of the money earned. The original film was produced by these people raising money from friends and family. This was not a big budgeted Hollywood film, but a truly independent film made by creative people. If you are a fan of the original film, I'm asking that you stand with them against this unauthorized rip-off.
